1. Agreement to Terms

 

By accessing or using the Glasify website (the "Site") and purchasing products from us, you agree to be bound by these Terms and Conditions ("Terms") and all terms incorporated herein by reference. If you do not agree to all of these Terms, do not use the Site or purchase products.

 

2. Changes to Terms

 

Glasify reserves the right to change or modify these Terms at any time, in our sole discretion. If we make changes, we will post the revised Terms on the Site and update the "Last Updated" date above. Your continued use of the Site following the posting of the revised Terms means that you accept and agree to the changes.

4. Product Sales and Availability

 

  • Product Descriptions: We attempt to be as accurate as possible with our product descriptions for all items (e.g., glassware, custom items, etc.) sold under the Glasify brand. However, we do not warrant that product descriptions, colors, or other content on the Site are wholly accurate, complete, reliable, current, or error-free.

  • Pricing: All prices are subject to change without notice. The price charged will be the price set out on the Site at the time the order is placed.

  • Availability: All products are subject to availability, and we reserve the right to impose quantity limits on any order, to reject all or part of an order, and to discontinue products without notice, even if you have already placed an order.

 

5. Orders and Payment

 

  • Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our final acceptance of your order. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.

  • Payment: You agree to pay all charges incurred by users of your payment card, account, or other payment method at the prices in effect when such charges are incurred. You will pay any applicable taxes relating to your purchases.

 

6. Shipping, Delivery, and Risk of Loss

 

  • Shipping: Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

  • Risk of Loss: The risk of loss and title for all products purchased from Glasify pass to you upon our delivery to the carrier. It is your responsibility to file any claims with the carrier for damaged and/or lost shipments.

 

7. Returns, Refunds, and Exchanges

 

  • Please review our separate Return and Refund Policy which applies to products purchased from Glasify.

  • For custom-made items, specific, stricter return/refund conditions may apply and will be clearly stated on the product page.

 

8. Intellectual Property

 

  • Ownership: The Site and all content, including but not limited to, the Glasify name, logos, product designs, text, graphics, images, and software, are the property of Glasify or its licensors and are protected by applicable intellectual property laws.

  • Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use only.

 

9. User Conduct and Content

 

  • Acceptable Use: You agree not to use the Site in any way that is unlawful, harmful, or violates the rights of others.

  • User Submissions: If you submit reviews, comments, or other content ("User Content") to the Site, you grant Glasify a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content. You are solely responsible for your User Content.

The Site and all products are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

In no event shall Glasify, its directors, employees, or agents be liable for any direct, special, indirect, or consequential damages, or any other damages of any kind, including but not limited to loss of use, loss of profits, or loss of data, whether in an action in contract, tort (including but not limited to negligence), or otherwise, arising out of or in any way connected with the use of or inability to use the Site or the products.
